These Terms of Use ("Terms") govern your access to and use of the Surflens mobile application, website, and related services (collectively, the "Services"), operated by WORKSTORIES, INC, a Delaware corporation ("Company", "we", "us", or "our").

 

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use the Services.

If you are under the age of 18, you represent that you have obtained consent from a parent or legal guardian.

You represent and warrant that:

  • you have the legal capacity to enter into these Terms;
  • you will comply with all applicable laws and local regulations related to surfing, ocean activities, and use of the Services.

The Services are intended for recreational use only. They are not designed for professional competition management, commercial filming services, or safety-critical use.

Certain features may require:

  • compatible devices (e.g., smartphones, smartwatches);
  • sufficient connectivity or permissions;
  • an active subscription or promotional access.

We reserve the right to suspend or terminate access if eligibility requirements are not met or if the Services are used in violation of these Terms.

2. Description of the Services

Surflens provides tools for automated video recording of surf sessions using mobile devices, cameras, and connected devices such as smartwatches. The Services may include recording, storage, playback, sharing, and analysis of video and session data.

 

We reserve the right to modify or discontinue any part of the Services at any time.

3. Accounts

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for:

  • maintaining the confidentiality of your credentials;
  • all activities conducted through your account, whether authorized or not;
  • securing your devices and access methods.

One user — one account. Accounts are personal and non-transferable. You may not share, sell, or sublicense access unless expressly permitted by the Company.

 

Device linkage. Your account may be linked to specific devices (e.g., smartphones, smartwatches). You are responsible for managing permissions, connectivity, storage, and compatibility of linked devices.

 

Unauthorized access. You must promptly notify us of any suspected unauthorized use or security breach. We are not responsible for losses resulting from unauthorized access caused by your failure to safeguard credentials.

Account suspension or termination. We may suspend or terminate your account, with or without notice where permitted by law, if:

  • you violate these Terms or applicable laws;
  • your use poses security, legal, or operational risks;
  • required by legal or regulatory obligations.

Data upon termination. Upon termination, access to the Services may cease and certain data may be deleted in accordance with our Privacy Policy and applicable law.

4. User Content and License

We may collect, use, store, and transfer the following categories of personal data:

  • You retain ownership of any videos, recordings, or other content you create or upload through Surflens ("User Content").
  • By creating, uploading, or otherwise providing User Content through the Services, you grant WORKSTORIES, INC a perpetual, irrevocable, non-exclusive, royalty-free, worldwide, transferable, and sublicensable license to use such User Content.
  • This license includes the right to:
    • host, store, reproduce, distribute, and publicly display User Content;
    • publish User Content in public sources, websites, and social media platforms;
    • use User Content for marketing, advertising, PR, promotional, and demonstration purposes;
    • edit, crop, modify, adapt, and create derivative works from User Content.
  • Such use may occur without additional notice to you and without payment of compensation.
  • Attribution may be provided at the Company’s discretion, unless otherwise required by law.
  • You represent and warrant that you have all necessary rights to grant this license and that your User Content does not infringe the rights of any third party.
  • You may request that the Company cease future marketing use of your User Content by contacting support@surflens.ai. Such request does not affect prior uses or the validity of the license granted.

5. Acceptable Use

You agree not to:

  • use the Services for any unlawful purpose;
  • interfere with or disrupt the Services or servers;
  • attempt to access systems or data without authorization;
  • upload content that is illegal, offensive, or violates third-party rights.

6. Subscriptions and Payments

We use your personal data to:

  • Certain features of the Services may require a paid subscription or other payment. Subscription plans, pricing, billing cycles, and included features are presented within the Services and may vary by region.
  • Free access, trials, and promotional use. The Company may, at its sole discretion, provide:
    • free access or extended trials;
    • complimentary subscriptions;
    • promotional or non-commercial access to selected users, ambassadors, surf instructors, surf camps, partners, or early testers.
  • Content-based compensation. In some cases, free or discounted access may be granted in exchange for content creation, such as videos, photos, testimonials, or social media posts featuring the Services. The scope, duration, and conditions of such access are determined by the Company and may be modified or revoked at any time.
  • No monetary compensation. Unless expressly agreed in writing, free access or promotional participation does not constitute employment, paid endorsement, or entitlement to monetary compensation.
  • Subscriptions and renewals. Paid subscriptions may renew automatically unless cancelled in accordance with the instructions provided in the Services or applicable app store policies.
  • Refunds. Payments are non-refundable except where required by applicable law or platform policies (such as Apple App Store or Google Play).
  • Changes to pricing. The Company reserves the right to change pricing, subscription tiers, or included features. Any changes will apply prospectively and will be communicated in advance where required by law.
  • Regional availability. Subscription options and pricing may differ by country or region and may be unavailable in certain locations due to technical, legal, or operational constraints.

7. Intellectual Property

  • The Services, including software, design, trademarks, and logos, are owned by or licensed to the Company.
  • Except for the limited license granted to you to use the Services, no rights are transferred.

8. Privacy

Your use of the Services is subject to our Privacy Policy, available at https://surflens.ai/privacy.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available".

 

We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law:

  • The Company shall not be liable for any indirect, incidental, special, or consequential damages.
  • Our total liability arising out of or relating to the Services shall not exceed the amount paid by you to the Company in the preceding 12 months.

11. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, liabilities, and expenses arising from:

  • your use of the Services;
  • your User Content;
  • your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms.

 

Upon termination, provisions that by their nature should survive will survive.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

14. Changes to These Terms

We may update or modify these Terms from time to time to reflect changes to the Services, legal requirements, or business practices.

  • Notice of changes. When changes are material, we will provide reasonable notice, such as by posting an updated version within the Services, on our website, or by other appropriate means.
  • Effective date. The date at the top of these Terms indicates when the latest version became effective.
  • Continued use. Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the revised Terms.
  • Right to discontinue. If you do not agree with the updated Terms, you must stop using the Services.
  • Non-retroactivity. Changes will not apply retroactively to disputes or claims that arose before the effective date, unless required by law.

16. Safety Disclaimer and Assumption of Risk

  • Surfing, ocean activity, and use of coastal environments involve inherent risks, including but not limited to:
    • strong waves, currents, rip tides;
    • collisions with other surfers, boards, or objects;
    • changing weather and visibility conditions;
    • serious injury, drowning, or property damage.
  • Surflens is a technical video recording and analysis tool only and:
    • is not a safety, navigation, or rescue system;
    • does not provide emergency assistance;
    • does not replace lifeguards, instructors, local rules, or personal judgment.
  • The Company does not guarantee:
    • uninterrupted operation of the Services;
    • accuracy of tracking, positioning, distance, or visibility indicators;
    • real-time performance, data availability, or signal reliability;
    • that recording will start, continue, or stop as expected.
  • You assume full responsibility for:
    • assessing ocean and weather conditions;
    • deciding when, where, and how to surf;
    • your physical condition and skill level;
    • compliance with local laws, beach regulations, and safety guidance.
  • Use of devices (including smartphones, smartwatches, tripods, mounts, and cameras) is at your own risk. The Company is not responsible for:
    • loss, theft, or damage of devices;
    • exposure to water, sand, salt, heat, or sun;
    • actions of third parties.
  • You acknowledge that:
    • focusing on recording or device feedback may be distracting;
    • safety must always take priority over capturing footage;
    • if conditions are unsafe, you should immediately stop using the Services.
  • By using Surflens, you knowingly and voluntarily assume all risks associated with surfing and use of the Services and agree that, to the maximum extent permitted by law, the Company shall not be liable for any injury, loss, or damage arising from such risks.

17. Third-Party Devices and Services

  • The Services depend on third-party hardware, software, and infrastructure, including but not limited to smartphones, smartwatches, operating systems, device sensors (GPS/compass), cameras, app stores, cloud providers, Wi‑Fi and cellular networks, and internet routing (collectively, “Third‑Party Systems”).
  • No control; no warranties. We do not control Third‑Party Systems and make no representations or warranties regarding their availability, accuracy, performance, security, or continued compatibility with the Services.
  • Connectivity and performance limitations. Recording, synchronization, tracking, and notifications may be affected by, or fail due to, Third‑Party Systems, including poor coverage, network congestion, throttling, roaming restrictions, background execution limits, OS updates, battery-saving modes, sensor drift, or device overheating.
  • Updates may break functionality. Operating system, firmware, or app-store policy changes may alter or restrict functionality (including background operation, camera access, Bluetooth/Wi‑Fi behavior, or location accuracy). We may not be able to restore prior behavior immediately or at all.
  • User responsibility. You are responsible for maintaining compatible devices, adequate power, storage, permissions, and network access, and for following any applicable safety and usage instructions for Third‑Party Systems.
  • No liability for Third‑Party Systems. To the maximum extent permitted by law, we are not responsible for outages, errors, data loss, missed recordings, delays, inaccuracies, or other issues caused by Third‑Party Systems.

18. DMCA and Copyright Complaints

If you believe content infringes your copyright, contact support@surflens.ai with sufficient information to identify the material and your claim. We may remove content in accordance with applicable law.

19. Arbitration and Class Action Waiver

  • Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration under Delaware law, except where prohibited.
  • You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

20. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with any policies or documents expressly incorporated by reference (including the Privacy Policy), constitute the entire agreement between you and the Company regarding your use of the Services and supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral, relating to the subject matter herein.

 

No failure or delay by the Company in exercising any right or remedy under these Terms shall operate as a waiver of such right or remedy. Any waiver must be in writing and signed by an authorized representative of the Company.

 

You acknowledge that you have not relied on any statement, representation, or promise not expressly set out in these Terms when deciding to use the Services.

    • accuracy of tracking, positioning, distance, or visibility indicators;

  • You assume full responsibility for:

  • The Services depend on third-party hardware, software, and infrastructure, including but not limited to smartphones, smartwatches, operating systems, device sensors (GPS/compass), cameras, app stores, cloud providers, Wi‑Fi and cellular networks, and internet routing (collectively, “Third‑Party Systems”).
  • No control; no warranties. We do not control Third‑Party Systems and make no representations or warranties regarding their availability, accuracy, performance, security, or continued compatibility with the Services.
  • Connectivity and performance limitations. Recording, synchronization, tracking, and notifications may be affected by, or fail due to, Third‑Party Systems, including poor coverage, network congestion, throttling, roaming restrictions, background execution limits, OS updates, battery-saving modes, sensor drift, or device overheating.
  • Updates may break functionality. Operating system, firmware, or app-store policy changes may alter or restrict functionality (including background operation, camera access, Bluetooth/Wi‑Fi behavior, or location accuracy). We may not be able to restore prior behavior immediately or at all.
  • User responsibility. You are responsible for maintaining compatible devices, adequate power, storage, permissions, and network access, and for following any applicable safety and usage instructions for Third‑Party Systems.

You must be at least 13 years old to use the Services.

The Services are intended for recreational use only. They are not designed for professional competition management, commercial filming services, or safety-critical use.

  • compatible devices (e.g., smartphones, smartwatches);
  • sufficient connectivity or permissions;
  • an active subscription or promotional access.

We reserve the right to suspend or terminate access if eligibility requirements are not met or if the Services are used in violation of these Terms.

Surflens provides tools for automated video recording of surf sessions using mobile devices, cameras, and connected devices such as smartwatches. The Services may include recording, storage, playback, sharing, and analysis of video and session data.

 

We reserve the right to modify or discontinue any part of the Services at any time.

3. Accounts

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for:

  • maintaining the confidentiality of your credentials;
  • all activities conducted through your account, whether authorized or not;
  • securing your devices and access methods.

One user — one account. Accounts are personal and non-transferable. You may not share, sell, or sublicense access unless expressly permitted by the Company.

 

Device linkage. Your account may be linked to specific devices (e.g., smartphones, smartwatches). You are responsible for managing permissions, connectivity, storage, and compatibility of linked devices.

16. Safety Disclaimer and Assumption of Risk

  • Surfing, ocean activity, and use of coastal environments involve inherent risks, including but not limited to:
    • strong waves, currents, rip tides;
    • collisions with other surfers, boards, or objects;
    • changing weather and visibility conditions;
    • serious injury, drowning, or property damage.
  • Surflens is a technical video recording and analysis tool only and:
    • is not a safety, navigation, or rescue system;
    • does not provide emergency assistance;
    • does not replace lifeguards, instructors, local rules, or personal judgment.
  • The Company does not guarantee:
    • uninterrupted operation of the Services;
    • accuracy of tracking, positioning, distance, or visibility indicators;
    • real-time performance, data availability, or signal reliability;
    • that recording will start, continue, or stop as expected.
  • You assume full responsibility for:
    • assessing ocean and weather conditions;
    • deciding when, where, and how to surf;
    • your physical condition and skill level;
    • compliance with local laws, beach regulations, and safety guidance.
  • Use of devices (including smartphones, smartwatches, tripods, mounts, and cameras) is at your own risk. The Company is not responsible for:
    • loss, theft, or damage of devices;
    • exposure to water, sand, salt, heat, or sun;
    • actions of third parties.
  • You acknowledge that:
    • focusing on recording or device feedback may be distracting;
    • safety must always take priority over capturing footage;
    • if conditions are unsafe, you should immediately stop using the Services.
  • By using Surflens, you knowingly and voluntarily assume all risks associated with surfing and use of the Services and agree that, to the maximum extent permitted by law, the Company shall not be liable for any injury, loss, or damage arising from such risks.

17. Third-Party Devices and Services

  • The Services depend on third-party hardware, software, and infrastructure, including but not limited to smartphones, smartwatches, operating systems, device sensors (GPS/compass), cameras, app stores, cloud providers, Wi‑Fi and cellular networks, and internet routing (collectively, “Third‑Party Systems”).
  • No control; no warranties. We do not control Third‑Party Systems and make no representations or warranties regarding their availability, accuracy, performance, security, or continued compatibility with the Services.
  • Connectivity and performance limitations. Recording, synchronization, tracking, and notifications may be affected by, or fail due to, Third‑Party Systems, including poor coverage, network congestion, throttling, roaming restrictions, background execution limits, OS updates, battery-saving modes, sensor drift, or device overheating.
  • Updates may break functionality. Operating system, firmware, or app-store policy changes may alter or restrict functionality (including background operation, camera access, Bluetooth/Wi‑Fi behavior, or location accuracy). We may not be able to restore prior behavior immediately or at all.
  • User responsibility. You are responsible for maintaining compatible devices, adequate power, storage, permissions, and network access, and for following any applicable safety and usage instructions for Third‑Party Systems.
  • No liability for Third‑Party Systems. To the maximum extent permitted by law, we are not responsible for outages, errors, data loss, missed recordings, delays, inaccuracies, or other issues caused by Third‑Party Systems.

18. DMCA and Copyright Complaints

If you believe content infringes your copyright, contact support@surflens.ai with sufficient information to identify the material and your claim. We may remove content in accordance with applicable law.

19. Arbitration and Class Action Waiver

  • Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration under Delaware law, except where prohibited.
  • You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

20. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with any policies or documents expressly incorporated by reference (including the Privacy Policy), constitute the entire agreement between you and the Company regarding your use of the Services and supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral, relating to the subject matter herein.

 

No failure or delay by the Company in exercising any right or remedy under these Terms shall operate as a waiver of such right or remedy. Any waiver must be in writing and signed by an authorized representative of the Company.

 

You acknowledge that you have not relied on any statement, representation, or promise not expressly set out in these Terms when deciding to use the Services.
